Lopez v. Schwartz Amicus Brief
The New Jersey-based Education Law Center, joined by Educate Nevada Now, filed this case in September 2015. The plaintiffs argue that Nevada’s education savings account (ESA) program violates the state constitution by diverting funding from public schools to private schools, reducing public school funding to inadequate levels and creating a non-uniform system of education and accountability standards. The Friedman Foundation filed an amicus brief in the case on November 13, 2015. On January 11, 2016, the judge from the First Judicial District Court of the State of Nevada in Carson City upheld the plaintiff motion for a preliminary injunction against the implementation of the program.
