New Hampshire Expands Education Freedom to All Students
Granite State Becomes Sixth in 2025 to Advance Universal Choice—and Fifth Nationwide to Offer True Educational Freedom and Choice
Today, Gov. Kelly Ayotte signed SB 295 into law, making New Hampshire the sixth state this year to either create or expand a school choice program to include all students. But the Granite State goes further than most, offering families not just access, but real autonomy through broad spending flexibility and guaranteed funding for every eligible student.
The legislation lifted income caps on the state’s Education Freedom Account program, ensuring that every K–12 student may participate. The education savings account (ESA) program allows families to use funds on a wide range of approved educational expenses, including private school tuition, tutoring, therapies, instructional materials, technology, and more. Unlike many other programs, New Hampshire’s ESA is funded through the state’s education funding formula—guaranteeing funding so that every student who wants to participate actually can.
“This is what educational freedom looks like, funding students, not systems, and trusting families to make the best choices for their children,” said Robert Enlow, President and CEO of EdChoice. “With this move, New Hampshire joins a short but growing list of states that offer true universal choice—where all students are eligible, all options are available, and all dollars are guaranteed.”
The ESA program has already proven to be popular with New Hampshire families. Since launching in 2021, approximately 5,600 students have enrolled, receiving an average ESA of $5,100 each year. The removal of eligibility limits means thousands more families will now be empowered to customize their child’s education. Prior to today’s expansion, only 45% of students in the state were eligible to participate.
“What New Hampshire has done isn’t just expand eligibility—it’s set a new benchmark for what educational freedom should look like,” Enlow continued. “We’re proud to support the Granite State in realizing the vision Milton Friedman outlined nearly 70 years ago—one in which every family has the freedom to choose, and every child has the opportunity to thrive.”
With the addition of New Hampshire, there are now:
- 76 private school choice programs in 35 states, plus Washington, D.C. and Puerto Rico;
- 19 states offering choice programs to all students;
- 5 states offering true educational freedom by allowing all students to choose from all options, and guaranteeing all dollars;
- 21 ESA programs in 18 states; and
- 45% of students eligible to participate in a private school choice program nationwide.
With this latest expansion, New Hampshire joins Arizona, Arkansas, Florida, and West Virginia in leading the nation toward a future of student-centered, flexible, and fully funded education options.
